It was stop-and-go traffic, and I was following too closely (since for one reason or another, I didn't stop in time). I must have been going 5-7 mile/hour at impact and the damage to both cars was very minimal (the assessing policeman marked it down as non-reportable--below $1000 dollars). He has a condition called Occular Hypertension which causes terrible pain and pressure in his eye at times. Auto Accident Personal Injury Claim Help? So, I was driving home, when a girl came speeding around the corner in my apartment complex on the wrong side of the road. Long story short, it got ruled 100% her fault. Now I ended up doing 6 months of chiropractic visits and 2 months of physical therapy. What merits a personal injury/negligence claim? Last week I was injured on my bike. I was riding at night on a sidewalk which abruptly ended in a mud hole. Question regarding personal injury claim and something called the egg shell skull/thin skull rule? I was wondering if someone could help me regarding a legal issue (regarding personal injury) my friend has – it is has something to do with what is known as the “EGGSHELL SKULL” rule (http://en.wikipedia.org/wiki/Eggshell_skull) which is basically the principle that you take a person as you find them but I have a question regarding its application. My friend was involved in a car crash (not his fault). He has been in a lot of pain since the accident with his back (he has been bed ridden for significant periods of time) and 20 months later has not recovered. A personal injury claim is still pending. However one expert he saw highlighted the fact that he had a back condition approximately 8 years earlier and thinks the crash merely accelerated what he thinks would have been a re-occuring condition (even though he has no interim problems with his back at all before the accident) and has only accelerated the back condition now. He thinks the accident accelerated the pain he is now in by between 12-24 months. Therefore the solicitor who is acting for him is only claiming for a maximum of 24 months of costs despite the fact that my friend is no where near recovered. My question is that surely this legal principle states that you take the victim as you find them therefore on my understanding it should make no difference as to what extent the accident accelerated the pain (be it 5 days or 5 months etc). Rather it should be that my friend had a propensity for a bad back and the accident triggered this off and that even if it takes 5 years for him to recover that should be what is claimed for and not the 12-24 months that the injury was accelerated. You have been very helpful sorry guys - I have looked into this further and I can't see anything about it needing to be an intentional tort or there needing to be any level of knowledge of the pre-disposition - most sites say it is just a matter of taking the victim as you find them - for example, this one from the guardian: "Egg-shell skull principle says a defendant must take his victim as he finds him. So if a person negligently injures someone by running them over, for example, they cannot complain if the injuries they have caused turn out to be more serious than expected because the victim suffered from a pre-existing weakness such as an unusually thin skull or a weak heart" Any thoughts?
What is the maximum you can claim for personal injury in a county court? I had an accident in work, they admitted liability and now we have to go to county court...is there a maximum set limit they pay out or is it up to the judges?
